How Divorce Mediation Works in Indiana

Mediation is a private, confidential process in which a neutral third party helps divorcing spouses communicate and work toward a settlement. The mediator doesn’t decide anything. Both parties retain control over the outcome, which is one reason mediation may produce agreements that remain workable over time compared to court-imposed orders.

Indiana’s Rules for Alternative Dispute Resolution govern how mediation sessions are conducted in domestic relations cases. Under ADR Rule 2.7, the mediator can hold joint sessions with both parties and their attorneys or separate caucuses to help each side work through positions privately. Critically, the mediator can’t give legal advice and can’t tell either party whether to accept a proposal. That’s your attorney’s role. A court may order parties to attempt mediation before proceeding to trial, but parties can also choose mediation voluntarily at any point in the process.

Mediation communications are confidential under Indiana ADR Rule 2.11. If sessions don’t produce an agreement, what was said during mediation generally can’t be used against either party in later court proceedings.

The Mediation Process From Preparation to Court Approval

Knowing what to expect at each stage helps you participate more effectively and reduces uncertainty along the way.

Preparation

Before sessions begin, your attorney helps you gather financial records, understand your rights under Indiana law, and set realistic goals for property division, custody, and support.

Sessions

The mediator may hold joint meetings or separate caucuses depending on what’s productive given the dynamics of the case. Your attorney advises you throughout, explains what any proposed term actually means legally, and helps you evaluate whether an offer reflects your interests.

Reaching a Written Agreement

If the parties reach agreement on all or some issues, the terms are put in writing, signed by both parties and their attorneys, and filed with the court. Under ADR Rule 2.7, the mediator submits a report to the court within ten days after mediation indicating whether an agreement was reached. Once a Marion County judge approves the agreement, it can become a binding court order enforceable to the same extent as any other judicial ruling.

Partial Agreement or No Agreement

Mediation doesn’t have to resolve everything to be worthwhile. If some issues are settled and others aren’t, the agreed terms can still be incorporated into the final decree while remaining disputes return to the litigation track. If no agreement is reached, the case continues in court with mediation communications protected from disclosure.

When Mediation May Not Be the Right Path

Mediation works when both parties can negotiate without coercion and are willing to participate in good faith. It isn’t the right process for every situation, and recognizing that early matters.

Domestic violence or abuse history: Cases involving a history of domestic violence or emotional abuse are generally not appropriate for mediation. The power imbalance can prevent meaningful negotiation and may lead to agreements that don’t reflect a fair outcome.
Unwillingness to participate in good faith: If one party conceals assets, refuses to engage honestly, or uses the process to delay, mediation is unlikely to produce a durable agreement.
Immediate child safety concerns: When a child’s safety or welfare is at immediate risk, an emergency court order may be the appropriate first step rather than a mediated process.
Significant power imbalances: Even without a history of abuse, situations where one party holds substantially greater financial knowledge or leverage can compromise the fairness of any agreement reached.
